Man Arrested After Using Leaf Blower in Brookline

A look at what possibly could've happened in Arlington had the seasonal ban been kept in place.

In what possibly could’ve been here in Arlington, a landscaper was arrested in Brookline Saturday for using a leaf blower and then refusing to identify himself to an officer, according to a Boston.com report.

The landscaper, 40-year-old Marvin Astillo of Waltham, was using the leaf blower, along with another man, at 850 Boylston St. in Brookline Saturday morning, according to the report. When an officer approached Astillo, he refused to give his name, and he was arrested and cited for two bylaw violations, according to the report.

A district court judge ultimately threw out the case before Astillo was even arraigned, as the incident was a civil, not criminal, infraction, according to the report.

Arlington passed a similar seasonal leaf-blower ban to Brookline, which bans the gas-powered devices from May 15 to Sept. 15 and before 9 a.m. on Saturdays, Sundays and holidays. However, in May, Arlington Town Meeting replaced the seasonal ban with a “compromise,” which greatly lessened the restrictions.
