The state is moving forward with all charges Arlington police brought against former Arlington selectman Annie LaCourt and her husband, Mark Burstein, last month. On Wednesday, Nov. 14, a district court magistrate found probable cause to charge the couple with furnishing alcohol to a person under 21, 33 counts each, according to Arlington Police Capt. Richard Flynn. Then, on Thursday, Nov. 15, a juvenile court found sufficient cause to charge them with contributing to the delinquency of a minor, three counts each, he said. The couple will be arraigned on the furnishing charges in Cambridge District Court, which is actually on Route 16 in Medford, on Friday, Dec. 21, he said. Former Arlington selectman Annie LaCourt and her husband, Mark Burstein, have been charged with furnishing alcohol to a person under 21 (33 counts each) and contributing to a delinquency of a minor (three counts each), according to an Arlington Police press release Monday afternoon. LaCourt and Burstein were allegedly caught Friday night having another underage drinking party at their Chatham Street residence, while they were home. Police said they found 33 teenagers at the house, 21 of whom were allegedly intoxicated. Most of them were 17, police said. Former Arlington selectman Annie LaCourt was allegedly caught Friday night having another underage drinking party at her Chatham Street home. LaCourt, who did not seek reelection in April after seven years on the board, and husband Mark Burstein are facing possible misdemeanor charges, according to Arlington Police Capt. Richard Flynn, after 33 teens, 21 of whom were allegedly intoxicated, were found partying at their house while they were home. State Justices ruled this week that party hosts would not be held liable if underage guests drink and drive and cause injury or death as a result.
Residents throughout the Commonwealth who choose to host "Bring Your Own Booze" parties are now free from liability if underage drinking occurs at those events and guests who drive drunk cause injuries, death or damage, according to a Boston Herald report Tuesday. The ruling derives from a majority opinion of Massachusetts Justices Fernande Duffly, Robert Cordy, Barbara Lenk, and Francis Spina, who claimed that social hosts can't be expected to "police their guests' drinking" and the ruling states that only hosts who supply alcohol to guests can be held legally responsible, according to the Boston Herald. Teens Caught Drinking About 7:17 p.m. on Thursday, police received a report of two teens drinking near Veterans' Memorial Rink. They told police they were "just hanging out," according to the police report. When asked by an officer if they had been drinking, they stated "no" repeatedly. If asked if police could look in their backpacks, both teens said they "felt uncomfortable with that," according to the report. They eventually admitted to having alcohol in their backpacks and to being 17 years old. The teens' parents were contacted.
