Pedestrian Struck at Cleveland Street and Broadway

The incident occurred at about 7:28 p.m. Monday.

A female was struck by a vehicle while she was crossing Cleveland Street at Broadway at about 7:28 p.m. Monday.

The female was sitting on the curb when officers arrived on scene. She said that when she was about halfway across the street, the vehicle hit her at a slow rate of speed. She said she ended up on the hood of the vehicle and then slid to the ground.

She was crossing in a crosswalk but said she did not know if she had the cross signal or not. She was transported to Mount Auburn Hospital in Cambridge with a possible injury to her right leg.

The driver told police that he was taking a left turn from Broadway onto Cleveland Street at the time of the incident. He said he had a green light and did not see the female, who was walking toward Arlington Center and was dressed in all black, until he struck her. He said he was going about 5 mph.

A witness told police that the driver did in fact have a green light and the female had the red “Do Not Cross” hand illuminated.

I honestly believe you have to be pretty dumb to get hit by a car.

So I'm curious... Given that the jaywalking pedestrian has right of way, what can the driver be charged with?
