Protect Yourself!

Divorce is unfamiliar, uncomfortable, and, in the least, unpleasant. A part of you feels like getting into bed with the covers over your head and not coming out until it’s over. The following is a list of some things you might not think about right off the bat, but that need to be addressed before, during and certainly after divorce.

1.  Change the beneficiary of your will if your spouse had been your beneficiary

2.  Change your health care proxy and health care power-of–attorney

3.  Change the names on your mortgage. It is important to remember that you remain responsible for your mortgage after divorce. Your obligation does not end with a divorce. If your name is on this or any other document you remain responsible for the liability. Eliminating your responsibility of the loan can be negotiated in the divorce but needs to be legally changed on the loan agreement not just be included in the divorce decree.

4.  The same is true for car leases, lines of credit, etc.

5.  Do you need representation at the IRS under the “innocent spouse” relief law in order to qualify to be relieved of tax, interest and penalties?

6.  Name change to revert to your maiden name
