A 47-year-old Arlington man was charged with attempted murder the morning of Friday, Jan. 11, after he allegedly choked another man and beat him with a remote control after the man wouldn’t give him a Percocet for his back pain.

Timothy J. Stewart, of Epping Street, was also charged with assault and battery with a dangerous weapon, assault and battery, intimidating a witness and resisting arrest after the incident.

Police responded to Stewart’s residence at about 4:09 a.m. Friday for a report of a dispute in progress.

There, the alleged victim told police that Stewart attacked him when he refused to give him one of his prescription Percocet pills. He said Stewart choked him multiple times to the point where he could not speak or breathe. One of the times, Stewart shouted at him that he was going to kill him, the alleged victim said.

When the alleged victim attempted to call police, Stewart allegedly threw the phone against the wall and ripped the phone’s cord out of the wall. When police attempted to arrest Stewart, he allegedly shouted “No [expletive] way!” and resisted.

According to the Arlington police report, “Due to the fact [Stewart] attempted an unlawful killing of [the alleged victim], with malice aforethought, by strangulation, with the intent to do grievous bodily injury to [the alleged victim], [Stewart] will be charged with attempted murder.”
